(C) El embajador utilizó una reunión individual con el Presidente Fernández el 5 de octubre para traer a colación, punto por punto, la gestión del cable de referencia sobre los requisitos del Departamento (de Estado) de que las personas recientemente nombradas como cónsul general en NY y cónsul general en San Juan deben comenzar a renunciar a su actual estatus como ciudadanos norteamericanos/residentes permanentes antes del 25 de octubre. El embajador le mencionó la intención del Departamento de hacer público su estatus y el hecho de que ningún cónsul general ante NY había sido acreditado desde enero de 2004.

3. (C) El presidente Fernández se sintió claramente incómodo con el requisito. Parece que él está enfrentando dificultades políticas. Preguntó “¿Podemos obtener una exención?” El embajador se comprometió a remitir su solicitud de una exención al Departamento, aunque sin ofrecer ninguna perspectiva de dicha exención.
4. (C) La embajada programó una gestión diplomática sobre este asunto al subsecretario del Ministerio de Asuntos Exteriores Rosario Graciano para el viernes, 13 de octubre, con la participación tanto del funcionario encargado y el cónsul general. El personal consular ya le informó al subsecretario lo esencial requerido de la gestión diplomática.
5. SOLICITUD DE ACCIÓN: Departamento favor darnos una respuesta a la solicitud del Presidente Fernández para exenciones o indulgencias de parte de EUA en lo que respecta a su nombramiento de un ciudadano norteamericano y un residente legal en posiciones diplomáticas de alta jerarquía que buscan acreditación en EUA.

2. (C) The Ambassador used a one-on-one meeting with
Dominican President Leonel Fernandez on October 5 to raise
point-by-point reftel demarche on the Department’s
requirement that individuals recently appointed as Consul
General New York and Consul General San Juan must begin
renunciation of current Amcit/LPR status before October 25.
Ambassador advised of Department’s intention to make public
their status and the fact that no Dominican Consul General
for New York had been accredited since January 2004.
3. (C) President Fernandez was clearly uncomfortable with the
requirement. It appeared that he was facing political
difficulties. He asked, «Can’t we obtain a waiver?» The
Ambassador undertook to convey his request for a waiver to
the Department, although without offering any prospect of
such a waiver.
4. (C) Embassy has scheduled a demarche on this subject to
MFA Under Secretary Rosario Graciano for Friday, October 13,
with both visiting desk officer and Consul General to
participate. Consular staff have already signaled to the
Under Secretary the expected substance of the demarche.
5. ACTION REQUEST: Department please provide reply to
President Fernandez’s request for waivers or U.S. indulgence
in the matters of his appointment of an AmCit and an LPR to
senior diplomatic positions seeking accreditation to the
United States.

2. (U) El 2 de febrero, el Encargado de Negocios se reunió con el Presidente Fernández a solicitud del Presidente. Fernández inquirió sobre la posibilidad de que la Reserva Federal estadounidense le suministre una carta de crédito stand-by al Gobierno dominicano. Señaló que la Reserva Federal le había dado algo similar a otros países, tales como México y Brasil, los cuales reconoció son economías mucho más grandes. (Nota: Parece que él se refería a los intercambios de moneda que la Reserva Federal hizo en octubre de 2008). Sin embargo, se preguntó si el gobierno norteamericano consideraría dicha solicitud dado los estrechos vínculos de los dos países bajo el acuerdo CAFTA-RD. Fernández dijo que RD no tiene planes inmediatos para dicha carta, pero que sería útil en caso de que tengan que devaluar la moneda. El Encargado de Negocios respondió que le preguntaríamos a Washington sobre el tema.
3. (C) Fernández quiso explicar sus recientes decretos en los que hizo una gran cantidad de nombramientos diplomáticos dudosos, incluyendo un cónsul general en Jacksonville, Florida, donde no hemos aprobado que se abra un consulado. Fernández dijo que hizo los nombramientos luego que el Canciller Morales le informara que EUA aprobó la apertura de nuevos consulados en Jacksonville, Filadelfia, Baltimore y Patterson, N.J. Dijo que Morales también le había informado que los residentes permanentes legales de EUA podrían ser nombrados como diplomáticos y que eran solamente los ciudadanos norteamericanos los que presentaban un problema. Reconociendo que ahora ya sabe que no permitimos que los que tienen tarjeta de residencia sean acreditados, Fernández solicitó una “exoneración” para que residentes legales puedan servir como diplomáticos. Dijo también que había cancelado los decretos relevantes. El Encargado de Negocios expresó nuestras inquietudes de siempre en cuanto a diplomáticos dominicanos asignados a EUA y citó el caso de Francisco Estévez, un cónsul en NY que fue acusado en EUA por tráfico de inmigrantes en diciembre de 2008. (Nota: Nos sorprendimos al saber que Fernández fue mal informado sobre la posición de EUA, ya que hemos tenido una serie de reuniones con el Canciller sobre el tema y no hemos sugerido que nuestra respuesta a la solicitud de abrir consulados, cuando sea entregada, sería positiva).
4. (C) Fernández solicitó información sobre el caso de la visa de Teonilde Casado de Cheung, la cónsul general dominicana en Hong Kong, quien recientemente fue detenida en NY (pero finalmente se le permitió pasar por tránsito) debido a una entrada vigilada relacionada con la solicitud pendiente de la Misión para que la visa de Casado sea revocada debido a corrupción. Fernández dijo que Casado era una amiga personal, que su bufete de abogados la había representado en el pasado y que ella necesita viajar a EUA porque tiene propiedades en Florida. Agregó que los hijos de Casado asisten a universidades en EUA y que uno de ellos había sido detenido en inmigración durante cinco horas durante el fin de semana, El Encargado de Negocios dijo que investigaría el asunto, pero señaló que existen restricciones sobre el tipo de información que podemos suministrar.
5. (SBU) Solicitud de acción:
(i) La Misión solicita instrucciones en cuanto a responder a lo inquirido por Fernández sobre una posible carta de crédito.
(ii) La Misión solicita que el Departamento (de Estado, NT) expedite su análisis a la solicitud de la Misión sobre la revocación de la visa de Casado (cable de referencia). El Encargado de Negocios quisiera tener la decisión final del Departamento antes de responderle al Presidente.
(iii) En cuanto a los diplomáticos dominicanos asignados a EUA, la Misión enviará una solicitud de acción en cable aparte.

1. (U) This is an action request; please see para. 5.
2. (SBU) On February 2, the Charge met with President
Fernandez at the President’s request. Fernandez inquired
about the possibility of the U.S. Federal Reserve providing a
stand-by letter of credit to the GODR. He noted that the
Federal Reserve had provided something similar to other
countries such as Mexico and Brazil, which he acknowledged
are much larger economies. (Note: It appears he was
referring to the currency swaps that the Federal Reserve did
in October 2008.) However, he wondered if the USG would
consider such a request given the close ties of the two
countries under the CAFTA-DR agreement. Fernandez said that
the DR had no immediate plans to use such a letter, but that
it would be useful in case they have to devalue the currency.
The Charge replied that we would inquire about the issue
with Washington.
3. (C) Fernandez sought to explain his recent decrees making
a large number of dubious diplomatic appointments, including
a Consul General in Jacksonville, Florida where we have not
approved the opening of a Consulate. Fernandez said that he
made the appointments after Foreign Minister Morales informed
him that the U.S. approved the opening of new consulates in
Jacksonville, Philadelphia, Baltimore, and Patterson, NJ. He
said that Morales had also told him that U.S. Legal Permanent
Residents (LPRs) could be appointed as diplomats and that it
was only American citizens that presented a problem.
Acknowledging that he now knows that we do not allow green
card holders to be accredited, Fernandez requested a «waiver»
so that LPRs can serve as diplomats. He also said that he
has canceled the relevant decrees. The Charge expressed our
longstanding concerns regarding Dominican diplomats assigned
to the U.S. and cited the case of Francisco Estevez, a Consul
in New York who was indicted in the U.S. for alien smuggling
in December 2008. (Note: We were surprised to hear that
Fernandez was misinformed on the U.S. position, since we have
had a series of meetings with the Foreign Ministry on this
issue and have not implied that our response to the request
to open consulates, when delivered, would be positive.)
4. (C) Fernandez requested information on the visa case of
Teonilde Casado de Cheung, the Dominican Consul General in
Hong Kong who was recently stopped in New York (but
ultimately allowed to transit) because of a lookout entry
related to Post’s pending request for Casado’s visa to be
revoked for corruption. Fernandez said that Casado was a
personal friend, that his law firm had represented her in the
past, and that she needs to travel to the U.S. because she
owns property in Florida. He added that Casado’s children
attend universities in the U.S. and that one of them had been
held up in immigration for five hours over the weekend. The
Charge said that he would look into the matter, but noted
that there were restrictions on what type of information we
can provide.
5. (SBU) Action requests:
(i) Post requests guidance on replying to Fernandez’s inquiry
on a possible letter of credit.
(ii) Post requests that the Department expedite its review of
Post’s request for concurrence on the revocation of Casado’s
visa (Reftel). The Charge would like to have a final
Department decision before replying to the President.
(iii) Regarding Dominican diplomats assigned to the U.S.,
Post will send an action request by Septel.

RESUMEN
1. (C) El Presidente Leonel Fernández, durante una reunión el 24 de agosto con el Encargado de Negocios, el subjefe de la Misión y el asesor económico/político:
– Solicitó una reunión bilateral con el presidente de EUA al margen de la Asamblea General de las Naciones Unidas o en Washington;
– Indicó que favorece gente con experiencia en la comunidad en la cual estarán sirviendo para ocupar posiciones consulares;
– No prevé reformas importantes, opinando que el Gobierno dominicano únicamente necesita ayuda financiera a corto plazo que sirva como “respiro” para poder enfrentar con éxito la crisis financiera internacional;
– Solicitó un incremento en los intercambios culturales y una reunión con los voluntarios del Cuerpo de Paz;
– Apoyó totalmente la resolución de la crisis política hondureña sobre la base del Acuerdo de San José; y
– Dio previo aviso sobre el viaje que hará a Libia este fin de semana para hablar frente a la Unión Africana.
El Encargado de Negocios y el subjefe de la Misión dijeron que ayudarán en la solicitud de una reunión bilateral con el presidente de EUA, informaron sobre una próxima cooperación contra el narcotráfico, ofrecieron programar una reunión para la semana próxima con el director del Cuerpo de Paz Williams, quien está de visita en el país, acordaron llevar a cabo las propuestas de intercambio cultural hechas por el Presidente y estuvieron de acuerdo en la necesidad de propulsar una resolución al problema hondureño de conformidad con el Acuerdo de San José. ¿UNA REUNIÓN BILATERAL CON EL PRESIDENTE DE EUA?
2. (C) El Encargado de Negocios preguntó si el Presidente asistiría a la Asamblea General de las NU en NY y, de ser así, si explicaría la necesidad de solicitar cualquier reunión bilateral con el presidente de EUA y/o el secretario pronto y no más adelante. Fernández dijo que asistiría a la Asamblea de las UN, como lo hace cada año, y que le gustaría sostener una reunión bilateral con el presidente de EUA en la Casa Blanca luego de la Asamblea de las NU, ya que recibió una invitación para hablar en la Universidad George Washington en esos días y aceptaría esta última invitación si se convoca una reunión con el presidente norteamericano. De no ser así, lamentó, las inquietudes sobre la política local evitarían que él acepte la invitación de la Univ. George Washington, ya que un viaje a Washington sin una reunión con el presidente norteamericano (fuese allá o en NY) sería criticado por los medios de comunicación locales. “LOS CÓNSULES DEBEN PROVENIR DE LAS COMUNIDADES A LAS QUE SIRVEN”
3. (C) El Presidente se sintió complacido de que el nombramiento de Rafael Evans como el nuevo cónsul general de RD en NY se aprobó a tiempo, y Evans tiene programado llegar al país más adelante en esta semana para renunciar formalmente a su estatus de residente legal permanente. No obstante, expresó inquietud que Evans podría tener problemas en recobrar su residencia permanente una vez que su período como cónsul general llegue a su fin. El Encargado de Negocios respondió que tenemos entendido que los hijos de Evans son ciudadanos norteamericanos y por tanto pueden pedir su residencia un vez que su nombramiento consular termine aunque otros residentes permanentes que deciden renunciar a su estatus de residentes legales permanentes podrían no ser elegibles para re aplicación a residencia permanente. Fernández declaró que piensa que “Los cónsules deben provenir de las comunidades a las que sirven”, y sugirió que el gobierno norteamericano instituya algún tipo de “programa de exoneración” para los residentes legales permanentes que renuncien a su estatus cuando aceptan un nombramiento consular de un gobierno extranjero, para que puedan recuperar su estatus inmediatamente como residentes estadounidenses una vez que su nombramiento diplomático termine.
NO HABRÁ IMPORTANTES REFORMAS: EL GOBIERNO DOMINICANO SIMPLEMENTE NECESITA UN RESPIRO
4. (C) Fernández ofreció una evaluación optimista de las perspectivas políticas y económicas de RD, describiendo su país como pacífico y democrático con un “dinámico” sector privado. La crisis financiera internacional afectó a RD, reconoció, con déficits en los ingresos los cuales crearon problemas fiscales y la necesidad de asistencia para enfrentar la balanza de pagos y las necesidades presupuestarias. En consecuencia, está enviando una misión a Washington para reunirse con el FMI, el Banco Inter-Americano de Desarrollo y el Banco Mundial, con el objetivo de negociar un acuerdo con el FMI que liberaría los desembolsos de préstamos de otras instituciones (cable separado) y “crearía mayor seguridad” para la economía dominicana. El Presidente afirmó que RD está en el camino correcto y que lo único que necesita es un “respiro” para sobrellevar la tormenta económica.

NARCOTRÁFICO Y CORRUPCIÓN
5. (C) El narcotráfico y la corrupción fueron citados por Fernández como los principales problemas que sigue determinado a resolver. Señaló que recientemente reemplazó al general que dirigía la DNCD con un general de la Policía (Ref B), lo cual deberá mejorar la cooperación entre la DNCD y la Policía Nacional para desmantelar los “20,000” lugares donde se venden narcóticos en el país. También solicitó un mayor apoyo de parte del CN (¿) estadounidense, añadiendo que RD estaba en proceso de adquirir un sistema de radar para rastrear a los narco vuelos. El Encargado de Negocios respondió que estamos trabajando con el Comandante de las Fuerzas Armadas para restaurar los helicópteros militares y que habrá un oficial en el país en septiembre para trabajar en la conclusión de un acuerdo para el programa. Con respecto a la corrupción, el Presidente dijo que su Gobierno trabajo con el Banco Mundial para aumentar la transparencia y externó su interés en participar en el financiamiento de la Corporación Desafío al Milenio.

LOS INTERCAMBIOS CULTURALES SON UNA PRIORIDAD
6. (C) Fernández expresó gran entusiasmo para aumentar los intercambios culturales. Se sintió particularmente orgulloso del programa de becas internacionales del Gobierno dominicano, el cual envía 1,200 estudiantes dominicanos a las universidades en el extranjero (120 a EUA). Él espera aumentarlos a 5,000 pronto y a 10,000 anualmente para el final de su período de gobierno. Con respecto a la cooperación cultural con EUA, pidió asistencia para promover los programas de bibliotecas, el desarrollo de una industria cinematográfica (PAS patrocinó un programa el año pasado del departamento de cinematografía de la Universidad de California en Los Ángeles (UCLA), orquestas juveniles y el desarrollo de la Ley de Defensa Nacional. El Presidente también elogió el Cuerpo de Paz, solicitando detalles de sus operaciones y expresando el deseo de reunirse con los voluntarios.
7. (C) El Encargado de Negocios dijo que el director del Cuerpo de Paz AaronWilliams visitará RD la semana próxima y ofreció programar una reunión con el Presidente, quien dijo que estaría fuera del país (ver abajo) pero que el vicepresidente podría reunirse con él. El subjefe de Misión dijo que le daría seguimiento a las oportunidades para intercambios culturales y a la solicitud de asistencia para la Ley de Defensa Nacional.
HONDURAS: ZELAYA DEBE SER REINTEGRADO
8. (C) La crisis política hondureña sigue siendo de gran inquietud para el Hemisferio, declaró Fernández, y sólo puede resolverse con el regreso del presidente Manuel (Mel) Zelaya al gobierno conforme al Acuerdo de San José, con inmunidad para todas las partes y elecciones nacionales que no incluyan ni a Zelaya ni al presidente del congreso Micheletti como candidatos. Dijo que ciertos sectores en EUA se concentraron demasiado en el apoyo que Zelaya estaba recibiendo de Chávez, de Venezuela y Castro de Cuba, enfatizando que los líderes democráticos del Hemisferio tales como Calderón de México y Lula de Brasil también insisten en ello. El Presidente opinó que la OEA debe utilizar al Cardenal Rodríguez, de quien dijo es la figura más respetada en Honduras, para que logre un acuerdo entre las dos partes. El tiempo se acaba, advirtió, con algunos países, como España, asumiendo la posición de que no reconocerán los resultados de ningunas elecciones que se lleven a cabo sin que antes se reintegren las normas constitucionales. El Encargado de Negocios y el subjefe de Misión estuvieron de acuerdo en la importancia de resolver la situación hondureña.

9. (C) A pesar de su interés en resolver el problema hondureño, el Presidente dijo que sacó al Canciller Carlos Morales Troncoso de la Misión de la OEA allá a último minuto para atender una emergencia. Fernández luego indicó que esta emergencia era su (el que hasta ahora no ha sido anunciado públicamente) viaje a Libia del 8/28-9/3, donde dijo que hablará ante la Unión Africana como representante de Latinoamérica y el Caribe sobre el tema de la importancia de la transición hacia la democracia.

COMENTARIO
10. (C) La reunión, que nosotros solicitamos como despedida del Encargado de Negocios y como visita de cortesía para el nuevo subjefe de Misión, le dio al Presidente la oportunidad de revisar sus prioridades en la agenda bilateral e internacional. La satisfacción de Fernández con la situación local refleja sus acciones de la semana pasada, en la que se hicieron mínimos cambios en su administración. Las medidas significativas que se hicieron: nombramiento de un nuevo director de la compañía de electricidad estatal CDEEE, revocación de la política del Gobierno dominicano de no hacer un acuerdo con el FMI, y el nombramiento de un alto oficial policial como director de la DNCD, reflejan sus inquietudes sobre la situación económica inmediata y el aumento del narcotráfico, uso de drogas y la violencia relacionada con las drogas aquí. A BILATERAL WITH POTUS?

2. (C) Charge inquired whether the President will be
attending the UN General Assembly in New York, and, if so,
explained the need to request any desired bilats with POTUS
and/or The Secretary sooner rather than later. Fernandez
said that he will be attending the UNGA, as he does every
year, and would like a purely bilateral meeting with POTUS
there. Alternatively, he said that he could meet POTUS at
the White House following the UNGA, as he has received an
invitation to speak at George Washington University then and
would accept the latter invitation if a meeting with the
President could be arranged. If not, he lamented, domestic
political concerns would prevent him from accepting the GWU
invitation, as a trip to Washington without a meeting with
POTUS (either there or in New York) would be played against
him by the local media. (COMMENT: Post is coordinating this

3. (C) The President was pleased that the appointment of
Rafael Evans as the DR’s new Consul General in New York was
on track, with Evans scheduled to arrive in country later
this week to formally renounce his Legal Permanent Resident
status. Nonetheless, he expressed concern that Evans might
have difficulty regaining LPR status once his term as CG is
over. Charge replied that it was our understanding that
Evans’ children were Amcits, and thus could petition for his
residency once his consular assignment terminated although
other LPRs choosing to give up their LPR status to take a
diplomatic position in the U.S. might not be eligible to
re-apply for permanent residency. Fernandez declared that he
believes, «Consuls should be from the communities they
serve,» and suggested that the USG institute some type of
«waiver program» for LPRs who renounce their status when they
accept a consular appointment from a foreign government, so
as to enable them to immediately regain their status as U.S.
residents once their diplomatic tour ends.

4. (C) Fernandez gave an upbeat assessment of the DR’s
political and economic prospects, describing his country as
pacific and democratic with a «dynamic» private sector. The
international financial crisis has affected the DR, he
acknowledged, with revenue shortfalls creating fiscal
problems and creating the need for assistance in addressing
the balance of payments and budgetary needs. Consequently,
he is sending a mission to Washington to meet with the
International Monetary Fund (IMF), the Inter-American
Development Bank and the World Bank, with the objective of
negotiating an accord with the IMF that would release loan
disbursements from the other institutions (Septel) and
«create greater certainty» for the Dominican economy. The
President averred that the DR remains on the right track, and

NARCOTRAFFICKING AND CORRUPTION

5. (C) Narcotrafficking and corruption were cited by
Fernandez as major problems he remains determined to deal
with. He noted that he recently replaced the military
general who headed the Directorate for Combating Narcotics
(DNCD) with a police general (Ref B), which should improve
cooperation between the DNCD and the National Police in
disrupting the «20,000» sites where narcotics are sold in the
country. He also requested increased U.S. CN support, adding
that the DR was in the process of acquiring a radar system to
track narcoflights. Charge replied that we are working with
the Commander of the Armed Forces on refurbishing the
military’s helicopters and will have an official in country
in September to work on concluding an agreement for the
program. With respect to corruption, the President stated
that his government is working with the World Bank to
increase transparency and voiced interest in participating in
Millennium Challenge Corporation funding.

CULTURAL EXCHANGES A PRIORITY

6. (C) Fernandez expressed great enthusiasm for increasing
cultural exchanges. He was particularly proud of the GoDR’s
foreign scholarship program, which this year is sending 1,200
Dominican students to universities abroad (120 to the U.S.).
He hopes to increase this to 5,000 soon and to 10,000
annually by the end of his term. With respect to the
cultural cooperation with the U.S., he asked for assistance
in promoting library programs, the development of an
cinematography industry (PAS sponsored a program last year
from UCLA’s cinematography department), youth orchestras and
developing the National Defense Law. The President also
praised the Peace Corps, requesting details on its operations
and expressing the desire to meet with the volunteers.
7. (C) Charge said that Peace Corps Director Aaron Williams
will be visiting the DR next week and offered to set up a
meeting with the President, who said he would be out of the
country (see below) but that the Vice President could meet
with him. DCM said that we would follow up on opportunities
for cultural exchanges and the request for assistance on the
National Defense Law.

HONDURAS: ZELAYA MUST BE RESTORED

8. (C) The Honduran political crisis remains a significant
concern for the hemisphere, Fernandez declared, and can only
be resolved with President Manuel (Mel) Zelaya’s return to
office pursuant to the San Jose Accord, with immunity for all
parties and national elections with neither Zelaya nor
Congress President Micheletti as candidates. He said that
certain sectors in the U.S. focused too much on the support
Zelaya was receiving from Venezuela’s Chavez and Cuba’s
Castro, emphasizing that democratic leaders in the hemisphere
such as Mexico’s Calderon and Brazil’s Lula also are
insisting on this. The President opined that the OAS should
utilize Cardinal Rodriguez, who he termed the most respected
figure in Honduras, to bring the two sides to agreement.
Time is running out, he warned, with some countries, such as
Spain, taking the position that they will not recognize the
results of any election held without a prior return to

constitutional norms. Charge and DCM agreed on the
importance of resolving the Honduran situation.

LIBYA BECKONS

9. (C) Despite his interest in resolving the Honduras
problem, the President said that he pulled Foreign Minister
Carlos Morales Troncoso from the OAS Mission there at the
last minute to deal with an emergency. Fernandez then
intimated that this emergency was his (thus far publicly
unannounced) trip to Libya from 8/28-9/3, where he said he
will speak to the African Union as the representative of
Latin America and the Caribbean on the subject of the
importance of the transition to democracy.

10. (C) The meeting, which we requested as a farewell call
by Charge and a courtesy call by the new DCM, provided the
President with the opportunity to review his priorities on
the bilateral and international agenda. Fernandez’
satisfaction with the domestic situation echoes his actions
of the past week, in which minimal changes were made in his
administration. The significant moves that were made: the
naming of a new head of the State electricity company CDEEE,
reversal of the GoDR’s policy not to seek an IMF agreement,
and the appointment of a senior police officer to head the
DNCD, reflect his concerns regarding the immediate economic
situation and the growth of drug trafficking, drug use and
drug-related violence here. END COMMENT.
